1. Acceptance of Terms
By accessing or using MyPhotoMap ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
2. Description of Service
MyPhotoMap provides a platform for users to upload, store, organize, and map their personal photographs. The Service offers both free and optional paid subscription tiers with varying features and storage limits.
3. IMPORTANT: Not a Backup Service
MyPhotoMap is NOT intended to be used as a primary backup service for your data or photographs.
You acknowledge and agree that:
- We do not guarantee the safety, integrity, or availability of your data.
- The Service may experience downtime, errors, or interruptions at any time for any reason.
- The Service may be discontinued or taken offline permanently at any time without prior notice.
- You are solely responsible for maintaining independent backups of all content you upload to the Service. We are not liable for any loss of data or photos.
- For all premium plans from Creator and above are allowed to export their data.
4. User Accounts
To access certain features, you must create an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. User Content
You retain all rights and ownership of the photos and content you upload. By uploading content, you grant MyPhotoMap a non-exclusive, worldwide, royalty-free license to host, store, and display your content solely for the purpose of providing the Service to you.
You agree not to upload content that is illegal, offensive, infringing on intellectual property rights, or violates the privacy of others. We reserve the right to remove any content that violates these terms.
6. Subscriptions and Payments
Certain features of the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions will automatically renew unless cancelled.
Cancellations and Account Deletion: You may cancel your subscription or delete your account entirely at any time through your account settings. If you choose to delete your account while you have an active pre-paid subscription (such as an annual plan), you will forfeit any remaining time on that billing cycle. No prorated refunds will be provided for partial billing periods or unused time. Upon account deletion, your active subscription will be immediately cancelled to ensure you are not charged for any future renewal periods.
7. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the Service will immediately cease, and your data may be deleted.
8. Limitation of Liability
To the fullest extent permitted by law, MyPhotoMap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.
9. Changes to Terms
We may modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
